Belgian Supreme Administrative Court says proposed Open Source preference law no good 

The Budget Commission of the Assembly of the French-speaking community of Brussels (Cocof) adopted on 11 February 2003 a proposal, which sought to oblige the Cocof administration to use exclusively Open Source Software (OSS). Martine Payfa, President of the Cocof Assembly, requested the legal opinion of the Supreme Administrative Court on the text. The Supreme Administrative Court delivered its opinion today, ruling that only the Belgian Federal Parliament, not Cocof, could propose such a law, and finding further that any such proposal would have to comply with related EU Directives as applied through current Belgian law.
